Recently, we learned that in 1989, Harriet Miers appeared to signify her "support for a constitutional amendment banning abortions" except when necessary to save the life of the woman. This new revelation came in the form of an unsigned questionnaire for the Texans United for Life. Such an amendment would outlaw abortion even in the case of rape, incest, or when a woman's health is in jeopardy. Seems like an open and shut case. Right? Except that the White House has created a circus of evasion and inconsistency in the Miers nomination.

Remember on Monday, there was also confusion over whether she believes in a right to privacy. The chairman of the Senate Judiciary Committee, Arlen Specter, says that in a meeting with Miers, she told him she supports the Supreme Court decisions Griswold and Eisenstadt, which guarantee a constitutional right to birth control. But later, according to news reports, she called Specter to say she had not indicated such a position. Meanwhile a Wall Street Journal article reported that the very day Bush nominated Miers, two Texas judges who know her well held a conference call with conservative groups assuring the anti-choice hardliners that she would vote to overturn Roe v. Wade.
